1. Introduction
Welcome to The Branding Maven LLC ("The Branding Maven", "we", "us", or "our") (www.thebrandingmavenmarketing.com). These Terms & Conditions govern your use of our website and services. By accessing our site or purchasing our services, you agree to comply with the terms outlined below.
2. Services Provided
The Branding Maven LLC provides the following services:
• Branding & Logo Design
• Marketing & Content Creation
• Digital Strategy
• Workshops & Coaching
• Other custom branding and marketing-related services
We also offer digital products, such as templates and guides. By purchasing any service or product, you agree to the terms specified herein.
3. Project Timeline & Capacity
The Branding Maven LLC maintains the right to adjust project timelines based on energetic and operational capacity. While we strive to meet all deadlines, we recognize the importance of maintaining work-life balance and mental well-being to deliver the highest quality service.
In the event that project timelines need to be adjusted due to capacity constraints:
• We will communicate any changes promptly
• Project deadlines will be extended accordingly
• No additional fees will be charged for timeline adjustments made by The Branding Maven LLC
• Clients will be kept informed of any changes and new completion dates will be provided as soon as possible
4. Payment Terms
4.1 Accepted Payment Methods
We accept the following payment methods: Square (credit/debit card), PayPal, Venmo, and bank transfer/ACH.
4.2 Individual Services
100% payment is due upfront before work begins.
4.3 Bundle Packages
• 50% deposit required to begin work
• Remaining 50% due at project midpoint
• All payments due within 5 business days of invoice
4.4 Monthly Retainers
• First month payment due upfront before work begins
• Subsequent months billed on the 20th of each month for the following month
• Payment due within 3 business days of invoice (by the 23rd)
• Work begins on the 1st after payment is confirmed
• 30 days notice required for cancellation
• First month is non-refundable
4.5 Late Payments
If a payment is not received within 5 business days of the due date, work will be paused and late fees may apply.
4.6 Refunds & Cancellations
All sales are final. We do not offer refunds or cancellations once a project has begun.
5. Revision Policy
• Each deliverable includes three (3) rounds of revisions at no additional cost
• Additional revisions beyond the included rounds will be billed at $75 per revision
• Revisions must be requested within 7 days of deliverable presentation
• Significant scope changes may require additional fees and timeline adjustments
6. Artificial Intelligence (AI) Tool Usage & Transparency
6.1 Client Choice: Clients have the option to opt in or opt out of AI tool usage on their project. This preference will be documented in the service agreement.
6.2 If Client OPTS IN to AI tool usage:
• The Branding Maven LLC will use AI tools ethically and strategically to enhance creative work, research, content generation, and project efficiency
• No personally identifying information about the Client, their business, or any individuals will be input into AI systems
• All AI-generated content will be reviewed, edited, and refined by The Branding Maven LLC before delivery
• Client will receive a comprehensive AI Transparency Document detailing which AI tools were used, how each tool was used, what safeguards were implemented, and data privacy measures
• Upon request, The Branding Maven LLC will provide an AI Stack Deck and overview of safety policies for each AI tool used
6.3 If Client OPTS OUT of AI tool usage:
• The Branding Maven LLC will not use any AI tools in the creation, development, or delivery of project materials
• All work will be completed using traditional methods and human creativity exclusively
• Project timeline may be adjusted to accommodate non-AI workflows
7. Child Protection Provisions
When projects involve minors (individuals under 18 years of age), the following additional protections apply:
• An authorized adult must act on behalf of the minor with documented parent/guardian permission
• No faces or identifying images of minors will be used without explicit written consent from the parent/guardian
• Minors will be kept as anonymous as the parents are comfortable with
• All public-facing content featuring or regarding the minor requires parent/guardian approval before publication
• Youth safety takes priority over marketing goals in all circumstances
• No personally identifying information about the minor will be entered into AI systems
8. Ownership & Intellectual Property
• Full ownership of branding and design work is transferred to the client upon final payment
• Clients may resell or modify designs only with prior written permission
• All content, including website materials, graphics, and resources, is copyrighted and may not be copied, distributed, or used without permission
Portfolio & Promotional Rights: The Branding Maven LLC retains the right to display and use all completed work for portfolio, promotional, and marketing purposes, including but not limited to: website portfolio, social media, marketing materials, case studies, and client testimonials.
Confidentiality: Client confidentiality will be maintained regarding sensitive business information shared during the project. Portfolio use will focus on visual deliverables and general project scope, not proprietary business information.
9. Communication & Response Time
The Branding Maven LLC operates on an async-first communication model. Both parties commit to responding in a timely manner when it makes sense for the project's progress.
Preferred Communication Methods:
• Text message for quick updates and check-ins
• Email for detailed feedback, deliverable reviews, and documentation
• Google Meet for strategy sessions, discovery calls, and presentations
We respect each other's boundaries while maintaining the professionalism required for business relationships.
10. Liability & Disclaimers
• No guarantees are made regarding business outcomes resulting from branding, marketing, or digital strategy services
• The Branding Maven LLC does not provide legal or financial advice. Our guidance is strictly related to branding and marketing strategies
• Clients are responsible for how they implement branding strategies and services provided
11. Governing Law
These Terms & Conditions are governed by the laws of the State of Indiana, USA. Any disputes shall be resolved under Indiana jurisdiction.
